Will or trust: which one do you need?

A will directs who receives your assets, but it usually goes through probate. A revocable living trust can transfer assets outside of probate and keep your family's matters private, but only if it is set up and funded correctly.

Many Naples families use both. Our wills and trusts attorneys explain the tradeoffs in plain terms and build the combination that fits.

A trust is often a good fit if you

  • Own real estate

In Florida or in more than one state.

  • Want less delay for family

Reduce time and administrative burden after a death.

  • Have minor or young beneficiaries

Set up structured distributions over time.

  • Value privacy

Keep financial matters out of the public court record.

  • Own a business

    Plan for control and succession.

  • Need a backup will

A pour-over will catches anything left outside the trust.

No. Trusts are common for homeowners, parents of young children and anyone who wants to spare their family probate.

Yes. A pour-over will catches any assets that were not moved into the trust.

Retitling assets, such as real estate and accounts, into the name of the trust. An unfunded trust does not avoid probate.
